In our country, Customs is a critical institution operating under the Ministry of Trade. Customs Clearance Service involves conducting business and transactions with the state in the passage of products or services through bonded areas in foreign trade transactions with a foreign country.<\/p>\n

The Customs Law No. 4458, which is a set of rules to be followed during foreign trade transactions, is Turkey's main source of law on customs matters. The purpose of this Law is to determine the customs rules applicable to goods and vehicles entering and leaving the Customs Territory of the Republic of Turkey. According to Article 5 of the Customs Law No. 4458, anyone may appoint a representative at the customs authorities to perform the disposals and transactions stipulated by the customs legislation. The representative must be a resident of the customs territory of Turkey, except for persons engaged in transit transportation or persons making incidental declarations.<\/p>\n

Representation may be direct or indirect. In the case of direct representation, the representative acts on behalf and account of another person, and in the case of indirect representation, he acts on his own behalf but on behalf of another person. The representative is obliged to declare that he acts on behalf of the represented person, to indicate whether the representation is direct or indirect and to submit the representation authorization certificate to the customs authorities.<\/p>\n

A Customs Broker is a self-employed person who follows and finalizes all kinds of customs procedures of goods or services subject to customs procedures through indirect representation and who is granted a license by the Undersecretariat of Customs. Within the scope of customs clearance services, customs brokers act on their own behalf but as the representative of another person through indirect representation. Customs consultants are obliged to declare that they act on behalf of the person represented and to submit the representation authorization certificate to the customs authorities.<\/p>\n

The most important factor that foreign trade organizations should pay attention to when choosing a customs clearance service is the selection of an experienced, reliable and authorized customs clearance company with the right guidance responsibility. It should not be forgotten that a wrong choice and incorrect transactions carry the risk of being easily evaluated within the scope of customs smuggling and penalties, and that these may expose foreign trade companies to irreparable costs, penalties, time and prestige losses.<\/p>\n
